These Terms of Use (the “Terms”) govern your access to and use of the website located at bstonerecovery.com (the “Site”), operated by Blackstone Financial LLC, an Ohio limited liability company doing business as Blackstone Recovery (“Blackstone,” “we,” “us”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Informational purposes only

The Site describes services Blackstone offers. Content on the Site is provided for general informational purposes only. It is not, and should not be relied upon as, legal, insurance, accounting, tax, or other professional advice, and it does not address the circumstances of any particular company, program, or claim.

2. No client relationship; not a law firm

Blackstone Financial LLC is not a law firm and does not provide legal advice or legal services. Using the Site, contacting us, or submitting information to us does not create a client, fiduciary, or professional relationship of any kind. A relationship with Blackstone is formed only by a written engagement agreement signed by both parties. Please do not send us confidential or sensitive information about your company or claims until an engagement agreement is in place and we have confirmed in writing that we represent your interests in the matter.

3. No offer; no guarantee of results

Nothing on the Site constitutes an offer to enter into an engagement on any particular terms. Descriptions of our methodology, engagement structures, and contingency arrangements are illustrative; actual terms are established per engagement. Past recoveries and illustrative examples do not guarantee or predict the outcome of any future matter. Whether recoverable value exists in any particular claim inventory or payment history can only be determined through review of the underlying records.

4. Intellectual property

The Site and its contents — including text, design, graphics, and logos — are the property of Blackstone Financial LLC or its licensors and are protected by applicable intellectual property laws. You may view, download, and print Site content for your internal, non-commercial evaluation of our services. Any other reproduction, distribution, or use requires our prior written consent.

5. Acceptable use

You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to gain unauthorized access to the Site or its hosting infrastructure; (c) interfere with the Site’s operation, including through automated scraping that burdens the Site; or (d) misrepresent your identity or affiliation in communications with us.

6. Third-party sites

The Site may link to third-party websites. Those sites are not under our control, and we are not responsible for their content or practices. Links do not imply endorsement.

7. Disclaimer of warranties

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BLACKSTONE FINANCIAL LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, AND THEY DO NOT APPLY TO THE TERMS OF ANY SIGNED ENGAGEMENT AGREEMENT, WHICH GOVERNS THE PARTIES’ RESPECTIVE RIGHTS AND OBLIGATIONS IN AN ENGAGEMENT.

9. Indemnification

You agree to indemnify and hold harmless Blackstone Financial LLC from claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or misuse of the Site.

10. Changes to the Site and these Terms

We may modify the Site or these Terms at any time. Changes take effect when posted, and the effective date above will be updated. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

11. Governing law and venue

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Hamilton County, Ohio, and you consent to the jurisdiction of those courts.
